Terms of service

These terms govern the use of SchoolRadar, operated by EduOrbiq. They are between us and the school that holds the subscription. Staff and parents use the platform under the school's account, and these terms apply to them through it.

1. The service

SchoolRadar is administration software for schools: admissions, attendance, fees, examinations, transport, library, communication and a parent portal. It is provided over the internet and is updated continuously.

There is no public sign-up. A school is onboarded by EduOrbiq, and accounts exist only for that school's staff and for the parents and pupils of the school.

2. Accounts

  • The school is responsible for who it gives an account to and for what permissions it grants them.
  • Credentials are personal. They must not be shared between people.
  • The school tells us promptly if an account is compromised, and we may suspend an account to contain a compromise.

3. The school's data

The records a school keeps on the platform remain the school's. We hold and process them on the school's instructions, as set out in the privacy policy, and we claim no ownership of them. On leaving, a school may have its data returned or deleted.

4. Messages sent to parents — acceptable use

The platform sends email and SMS on a school's behalf, and the rules below are a condition of that. They exist because a school that breaks them damages the deliverability of every other school on the platform.

  • Write only to the parents, guardians and staff of your own school, at addresses and numbers they gave you. Do not import a purchased, rented or scraped list.
  • Send messages about the school's business — fees, attendance, results, notices and events. Do not send third-party advertising through it.
  • Act on requests to stop. Remove or suppress an address when a parent asks, rather than asking them to ask again.
  • Do not attempt to send from an address the school does not control, and do not reuse another school's sender.
  • Keep the records current. Repeatedly writing to addresses that no longer exist is the single fastest way to lose a sending account.

We monitor bounce and complaint rates. Where a school's sending puts the platform at risk we will contact the school and, if necessary, suspend its ability to send before the provider suspends everyone's. Addresses that hard-bounce, and addresses that complain, are suppressed automatically and cannot be sent to again.

5. Acceptable use generally

  • Do not use the platform unlawfully, or to store material you have no right to store.
  • Do not attempt to reach another school's data, probe the service for weaknesses without our written agreement, or interfere with its operation.
  • Do not resell or sublicense access, or use the platform to provide a service to a school that is not the one named on the subscription.

6. Fees and payment

Subscription charges, the period and the notice required are set out in the agreement with the school. Fees a school collects from its own parents through the platform are the school's money: they are settled to the school's own bank account by the payment gateway, and we neither hold nor take a share of them unless the agreement says so.

7. Availability

We aim to keep the service available at all times and will give notice of planned maintenance where we can. We do not promise uninterrupted service, and access may be interrupted by faults, by a provider we depend on, or by events outside our control.

8. Suspension and termination

We may suspend an account for non-payment, for a breach of clauses 4 or 5, or where continuing would put other schools at risk. Except in an emergency we will tell the school first and give it a chance to put things right. A school may end its subscription on the notice set out in its agreement, and may take its data with it.

9. Liability

The platform records what a school enters. Decisions a school takes on those records — a fee demanded, a result published, a pupil marked absent — remain the school's. We are not liable for indirect or consequential loss, and our total liability is limited to the fees paid for the service in the twelve months before the claim. Nothing here limits liability that cannot be limited by law.

10. Changes

These terms may change. The date at the top changes with them and schools are told before a material change takes effect.

11. Law

These terms are governed by the laws of India, and the courts of India have exclusive jurisdiction over any dispute arising from them.
